馬英九總統23日為衛生福利部揭牌，政大教授徐世榮與學生在封鎖線外聲援大埔事件，當場被警方逮捕，並有學生被警察撂倒、撞傷頭部。民進黨主席辦公室主任王閔生今（24）日召開記者會直斥，「面對手無寸鐵的學生、教授，需要如此粗暴對待嗎？」
王閔生說，民進黨主席蘇貞昌已指示，民進黨將籌組律師團，只要政府逾越法律界線，站在公民運動人權保障的立場上，民進黨一定做公民運動的後盾、提供法律的協助，幫助人民對抗粗暴的政府。
民進黨發言人林俊憲指出，馬英九不願傾聽民意，現在連看都不願意看到，那些教授、學生，距離馬英九還有幾十公尺遠，居然被警察與總統維安人員用非常粗魯手段予以逮捕，甚至造成學生受傷流血，「台灣是個警察國家嗎？」
林俊憲表示，民進黨也特別點名國安局長蔡得勝，國安局維護國家元首雖有其必要，但也有其分寸，「實在太過分了」。
他說，馬總統以後如果遇到相關抗議都要這樣做嗎？台灣是回到戒嚴的時候嗎？台灣在馬總統主政這幾年，真的是走回頭路，民主自由大倒退，台灣已經呈現警察國家的隱憂，民進黨在此向馬總統提出最大的抗議。
