國道全面監控　學者：交部應定義是否違法

【唐鎮宇／台北報導】內政部警政署要求交通部高公局及遠通電收提供所有國道車輛的行車記錄，資策會科技法律研究所組長郭戎晉說，身為主管機關的交通部應解釋若提供此資料是否違反《個資法》，而不是「尊重遠通電收」，把責任推給民間企業。

郭戎晉解釋，過去對於資料是否為個資，法務部多讓目的事業主管機關認定。國道收費是交通部業務，遠通電收可能只是公務機關受託者的角色，因此身為主管機關的交通部必須負責定義。

郭戎晉說，若有安裝eTag的民眾，須看雙方的合約是否有約定可提供資料給警政機關；若沒有裝eTag的民眾，得回到警政署這樣的要求是否符合公共利益、是否逾越必要程度。但郭也認為，此舉就像中國要求電信公司交出全民上網的IP位址，確實逾越《個資法》。
